Competition Terms and Conditions

1. Promoter

1. The following lays out the terms and conditions (“Terms and Conditions”) for our Instagram competition (Prize “Competition”) The promoter of this competition is Dog Furiendly LTD, company number 12220891, hosted on Instagram (instagram.com/dogfuriendly).
2. Although Dog Furiendly is the official Promoter of the competition; this competition is run in partnership with Bethnal&Bec, Four Seasons Hotel and Parkway Hotel who may also promote the competition (Partner).
3. This Competition is Sponsored and run in partnership with Pooch Pass, Bethnal&Bec, Four Seasons Hotel and Parkway Hotel, who is responsible for coordinating the prize (Sponsor).

6. In addition to these Terms and Conditions, you hereby agree to comply with the following policies of Facebook, Twitter and Instagram (as applicable):
   1. The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook, TikTok, Twitter or Instagram.
7. These Terms and Conditions are in addition to Our Privacy Policy, accessible at https://dogfuriendly.com/privacy-policy/, and governs how we may use the data we collect from you.
8. By entering for the Competition as outlined below, you agree to be bound by these Terms and Conditions. Any amendments to these Terms and Conditions will be posted on the relevant Competition Promotion Page.
9. The Promoter reserves the right to cancel or amend the Competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the Competition will be notified to entrants as soon as possible by us.
10. Dog Furiendly reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment

2. Eligibility to Enter 

1. The competition is open to residents of the United Kingdom aged 18 years or over.
2. All persons involved in the development/operation of the competition including Dog Furiendly, employees, directors and their respective families and household members are excluded from the participation of this competition.
3. Brand Ambassadors of Dog Furiendly are not involved in the development/operation of this competition and are therefore eligible to enter the competition.
4. We reserve the right to verify the eligibility of all entrants.
5. You must be able to comply with all the Terms and Conditions.

3. Competition and Entry Requirements

1. The competition will open on the 17th March at 11AM and close on 30th March 2023 11:59PM. 
2. After this date, no further entries to the competition will be permitted.
3. To enter the competition on Instagram you must
   • Follow @poochpass, @fourseasonsstfillans, @parkwayhotelspa, and @bethnalandbec on Instagram.
   • Comment on the giveaway post with their preferred location – England, Wales, Scotland, or “All”.
4. Winners will be announced after the 30th March and will be announced after confirmation with the winner.
5. By entering this competition an entrant is indicating his/her agreement to be bound by these terms and conditions.
6. We do not accept any liability arising from any such errors, omissions, interruptions or delays.
   1. No responsibility can be accepted for entries not received for whatever reason. Including entries which are lost or corrupted or any entries which We do not receive as a result of any technical error, however, caused. 
   2. In addition, we cannot accept any liability for any difficulties experienced in submitting an entry.
7. We endeavour to provide reasonable adjustments, where possible, for competitors who declare a physical, sensory or learning difficulty to us at any stage of the Competition. If you require any reasonable adjustments to be able to enter the Competition we can provide information in different formats to make it more accessible.
8. Entry into the Promotion is at the entrant’s sole risk. To the extent permitted by law, the Promoter, Partner and Sponsor do not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter, Sponsor and Partner also further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude liability resulting from its negligence or fraud.
9. If for any reason, the Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
10. If an act, omission, event or circumstance occurs which are beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

4. Prize

1. Prize draw winner will be randomly selected by a computerised random generator from all entries.
2. There will be three winners, each of whom will receive a one-night stay at one of the partner locations in the UK:
   • Bethnal&Bec (https://www.bethnalandbec.com)
   • Four Seasons Hotel (https://www.thefourseasonshotel.co.uk/)
   • Parkway Hotel (https://www.parkwayhotelandspa.com/
3. All stays are dog-friendly and will be scheduled outside of peak holiday times. 
4. Any additional adults, children and dogs can be added for a small supplement. 
5. Each holiday can must be taken by 31st March 2024.
6. In addition to the stay, each winner will also receive a year subscription to Pooch Pass. 
7. We will be forwarding your details to the companies that will be providing the prizes so they are able to get in touch with you to organise the delivery of your prize. Your data will be handled in accordance with our Privacy Policy.
8. There are no Prize substitutions or cash alternatives and the Prize is not transferable, non-refundable or exchangeable.
9. The prize is subject to availability excluding school holidays, bank holidays and any special breaks.
10. The Promoter reserves the right to substitute a prize of equal or greater value should circumstances outside its control make this necessary.
11. Travel not included. The Winner(s) (and any permitted companion(s)) will be solely responsible for their own travel and any and all other expenses incurred in connection with that Prize. We assume no responsibility and are not liable for any costs, charges or expenses which the Winner(s) (and any permitted companion/s) may be required to pay at any time in connection with their Prize.

5. Disqualification of Entry

1. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
2. We reserve the right (in Our sole discretion) to disqualify any entrant, entry or person we reasonably believe to be responsible for or associated with, such activity:
   1. If we have grounds to suspect any entrant of cheating, deception or fraudulent or unsportsmanlike conduct of any kind. 
3. We reserve the right to disqualify you from a Competition and/or report, remove or block you from (or remove your entry or comment from) the relevant Blog/Facebook Page/Twitter Page/Instagram Page if your entry or any comment from you is, or may reasonably be considered to be, defamatory, offensive, libellous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, corporation or entity or if we have reasonable grounds to believe that you have breached any of these Terms and Conditions.
4. In the case of disqualification, you will not be entered into the competition, nor will you be eligible to enter any future competitions featured at Dog Furiendly.
5. No third party or bulk entries. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, multiple email accounts, multiple reproduced or computer-generated entries, using multiple identities, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter or otherwise acting in violation of these terms, these participants will be disqualified, and any prize entitlement will be void.

6. Winner

1. The winner agrees to the use of his/her name and image in any publicity material for the Competition Promotion.
2. The winners will be notified within 14 days of the closing date and will have 14 days from notification to claim their prize. If a winner does not claim their prize within this timeframe the Promoter reserves the right to withdraw prize entitlement and will award the prize to a reserve drawn at the same time as the original.
3. It is the responsibility of the entrant to provide correct, up-to-date details when entering the prize promotion and acceptance of the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize
4. Promoter’s decision is final and binding. No correspondence will be entered into. Entry implies acceptance of these terms and conditions.
5. The Promoter reserves the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.
6. The name and county of the winner can be obtained by sending an email, 28 days after the prize promotion closing date to [email protected]

7. Limitation of Liability

1. We cannot be held responsible for any costs incurred by you in entering the Competition or in relation to you taking part in a Competition.
2. We shall not be responsible for any losses you suffer as a result of Our breach of these Terms and Conditions unless those losses were reasonably foreseeable to both you and Us at the date you enter a competition. 
3. Standard mobile data and internet connection charges may apply. Dog Furiendly cannot be held liable for these charges.
4. We do not accept any responsibility for or liability in respect of the content of our competition partners websites, the owners of which do not necessarily have any connection, commercial or otherwise, with us. Using automatic links to gain access to such sites is entirely at your own risk.
5. For the avoidance of doubt, we shall not be liable to you, in contract, tort (including, without limitation, negligence) or otherwise in connection with a competition for:
   1. loss of revenues, profits, contracts, business or anticipated savings or loss of data; or
   2.  any loss of goodwill or reputation; or 
   3. any special or indirect or consequential losses, however caused.
6. Nothing in these Terms and Conditions shall exclude or limit Our liability:
   1. for death or personal injury resulting from Our negligence or a deliberate act or omission of Us or any of Our officers, employees or agents; 
   2.  for fraud or fraudulent misrepresentation; or 
   3. to the extent that liability cannot by law be excluded or limited
7. We shall not be liable for any damages or losses as a result of the failure by us to deliver a competition, prize or any other prizes as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data nondelivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and/or failure or lack of reception of telephone or mobile telephone networks

8. Your Liability to Us and Your Statutory Rights

1. By taking part in the competition, you agree to fully indemnify us in respect of all liabilities, damages, claims, actions, expenses (including reasonable legal fees), demands or costs incurred by us as a result of any breach by you of the Terms and Conditions. 

9. Your Data

1. Your personal data shall be used solely in accordance with the current data protection legislation and in accordance with Our privacy policy which governs our use of the personal data We collect from you. 
2. Any personal information that entrants share with the Promoter will be kept secure and only used in line with these terms and conditions unless the entrant has opted into future marketing from the Promoter and associated Supplier. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion and winners consent to give their name and county for the winners’ list.

10. Governing Law 

1. These Terms and Conditions are governed by and construed in accordance with English Law and any dispute arising from them shall be subject to the exclusive jurisdiction of the English Courts.
   1. These Terms and Conditions are created in compliance with the CAP and ASA regulations to provide all “significant conditions”. Further to the CAP and ASA regulations:
      1. We do not allow sponsors or prizes that cause excessive consumption or irresponsible use. 
   2. Personal data of entrants is being collected and processed under our privacy policy, found on our website. This complies with the General Data Protection Regulations (GDPR) and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR).
2. Dog Furiendly has taken all measures, as far as they are aware, to comply with all relevant laws, regulations and processes for the purposes of this Competition.
